Five questions identify the ownership state

  1. Whose estate and which death?

    Build the civil-status chain and identify the documents and law relevant to each succession event.

  2. Estate or co-ownership?

    An undivided estate and registered co-ownership are not interchangeable labels and may require different acts.

  3. All relevant people

    Identify heirs, owners, spouses, representatives, minors or protected persons and evidence of each role without assuming the family list is complete.

  4. Exact property asset

    Match registry, tax, geometry and estate inventory; a family name for a field may not match one legal property.

  5. Act and authority

    Sale, partition, correction and division are different acts. Counsel must identify who can do each and in what order.

Physical occupation is not the legal map

  1. ‘This part is mine’

    Exclusive occupation or family allocation does not automatically create a separately registered parcel.

  2. ‘Most heirs agree’

    Do not infer the required authority or effect. Identify the exact act and every necessary consent or procedure.

  3. Tax record in one name

    A tax entry does not by itself settle succession, ownership shares or authority to sell.

  4. Old deed supplied

    Check subsequent deaths, transfers, registrations, corrections and pending entries before relying on it.
