The National Ecological Reserve (REN) protects areas tied to water, the coast, ecological processes and natural hazards. A proposal depends on the current published boundary, the affected REN category, the exact location of the works and what they involve. Treat an overlap as a reason for official verification, not a verdict for the whole plot. The simple rule: The current legally published REN delimitation, every affected typology and the precise proposed action determine the competent procedure; a map overlap alone is not a building verdict.

  1. Which delimitation is legally current?

    REN is delimited municipally and changes through published acts, alterations, corrections, exclusions or reintegrations. A national legal framework alone does not locate the current boundary for a parcel.

  2. Which typology or typologies overlap?

    REN is not a single ecological label. Coastal, water-cycle and natural-risk typologies protect different functions, and more than one typology can overlap the same area and require cumulative checking.

  3. What exact action is proposed?

    A house, enlargement, access road, excavation, fill, vegetation removal, water work or maintenance action cannot be analysed as the same factual operation. Define the intervention geometry and physical works.

  4. Is there a current statutory route for that action and typology?

    Compatibility requires both protection of the affected typology's functions and the correct current legal category and conditions. Being listed as exempt from prior REN communication is not approval and does not remove material conditions.

  5. Which other regimes remain?

    PDM, RJUE, RAN, water, Natura 2000, wildfire, heritage and other controls remain independent. A favourable REN outcome does not neutralise them.

The result remains unresolved until the published legal map, full dynamics, document scale and transformation issues are reconciled. The competent authority may settle the conflict through an official extract or written clarification; Land Insights does not collect that case-specific material.

A building or ruin is visible inside REN

Visibility in an image, registry or tax record does not prove lawful construction or current use. A prior lawful title may matter within its precise scope, but it does not automatically protect later enlargement, reconstruction or change of use.

What municipal title, date, authorised footprint and use can be proved?

Use the strongest available map and publication chain

  1. Published act and legal map

    Identify the Diário da República act, official map, legend, explanatory material and effective date, together with every later alteration, correction, exclusion and reintegration.

  2. National Territorial Information System (SNIT) record and official georeferenced image

    Use SNIT to follow the instrument and version history. Where vector alignment is doubtful, guidance from the Directorate-General for Territory (DGT) requires checking the georeferenced image corresponding to the officially published map.

  3. DGT vector service

    The official vector is valuable for screening and reproducible overlay, but DGT warns that transformation or updating differences mean it does not replace confirmation against the published map.

  4. Municipal master-plan (PDM) constraints map and viewer

    Use these as a cross-check and navigation source. If they conflict with the REN publication chain, record the conflict and ask the competent authority to resolve it.

  5. Parcel and intervention geometry

    A point or centroid is insufficient. Record the geometry source and quality and, near a boundary, use a qualified survey and official clarification proportionate to the decision.

A six-step REN verification route

  1. Fix the parcel and intervention geometry

    Keep parcel boundary, proposed works and existing structures separate. Record source, coordinate system and uncertainty rather than drawing legal conclusions from a sales pin.

  2. Current municipal publication chain

    The original delimitation, all current dynamics, authoritative maps, legends, dates and any exclusion or reintegration information relevant to the location form the publication chain.

  3. Record every typology and spatial relationship

    Distinguish full overlap, partial overlap, boundary uncertainty, source conflict, no hit in a named source and not assessable. Preserve multiple typologies.

  4. Describe the actual works clearly

    State use, works, area, excavation or fill, vegetation effects, access, water interaction and whether lawful existing works are involved. Product labels are not a legal action category.

  5. Screen the current legal route

    Match the action to the affected typology, current statutory annex and implementing conditions. Label it only as a possible procedural category, never as approval or success probability.

  6. Competent written route outside Land Insights

    The Câmara and territorial CCDR determine the applicable REN procedure, required documents, specialist participation and coordination with municipal and other restriction processes. Land Insights does not collect submission material or establish that route.

Does REN mean an absolute ban on every activity?

No uniform answer applies to every action. REN strongly restricts listed land transformations, while current law defines limited action–typology routes and conditions. The competent authorities must apply them to the real case.

If the online map shows no REN, is the plot clear?

No. Report only the result in the named source and version. Confirm the current published municipal map and full legal-change chain, especially where data are missing, old or misaligned.

If REN covers only a small part, can I use the rest?

Do not infer that from area alone. Confirm the boundary and intervention position, then check PDM parameters, access, infrastructure and every other restriction for the proposed location.

Does “exempt from REN prior communication” mean approved?

No. It addresses one procedural step only. Material REN conditions and all municipal, water, conservation, RAN and other requirements remain.

Does a ruin create an automatic REN exception?

No. The lawful title, authorised footprint and use, and the distinction between maintenance, reconstruction, enlargement and new building are determined in the later authority review. Who should confirm the REN procedure?

Start with the Câmara and territorially competent CCDR, which can identify the current delimitation and route. APA or other authorities may participate depending on the typology and action.

Does a favourable REN outcome allow the project to proceed?

It resolves only the REN aspect within its exact scope and conditions. The PDM, RJUE and every other applicable specialist regime still require their own conclusions and titles.
